Subsidiary Legislation

A number of regulations have been adopted under the Competition Ordinance (Ordinance) :

• Statutory bodies are excluded from the application of certain provisions of the Ordinance. However, six statutory bodies are subject to provisions of the Ordinance by virtue of the Competition (Application of Provisions) Regulation (Cap 619A).
• Seven entities related to Hong Kong Exchanges and Clearing Limited are specifically excluded from the application of the First and Second Conduct Rules by virtue of the Competition (Disapplication of Provisions) Regulation (Cap 619B).
• The Competition (Turnover) Regulation (Cap 619C) specifies the method for determining the turnover of an undertaking for the purpose of the Ordinance.
• The fees payable for applications to the Commission and the Communications Authority are prescribed under the Competition (Fees) Regulation (Cap 619G).

In addition, procedural and fees rules for the Competition Tribunal have been made by the Chief Judge of the High Court:

• The Competition Tribunal Rules (Cap 619D);
• The Competition Tribunal Fees Rules (Cap 619E);
• The Competition Tribunal Suitors’ Funds Rules (Cap 619F).
